Health Care Law
The health care industry is subject to a number of statutory, regulatory, and other legal requirements and restrictions. Health care facilities and practitioners often are faced with questions about laws that require the protection of confidential health information under HIPAA, limitations on business interactions between health care facilities and providers under the Stark Act and Anti-kickback statutes, and a host of other legal requirements.
In South Carolina, certain health care facilities also are required to obtain a Certificate of Need from the South Carolina Department of Health and Environmental Control before constructing and operating a facility. These facilities can include hospitals, ambulatory surgical centers, inpatient psychiatric facilities, nursing homes, and home health facilities.
